These Terms of Service ("Terms") govern your use of www.drinkfullswing.co.za (the "Site") and any related services provided by FSCO (Pty) Ltd ("Full Swing," "we," "us," or "our").

By accessing or using our Site, you agree to these Terms. If you do not agree, please do not use our Site or Services.

1. Changes to These Terms

We may update these Terms from time to time. Changes will be effective when posted on this page, with the updated "Last updated" date. If required by law, we will notify you of material changes.

2. Eligibility

To use our Services, you must:

  • Be at least 18 years old (or have consent from a legal guardian).
  • Provide accurate and complete information when making purchases or creating an account.
  • Use the Site only for lawful purposes.

3. Orders & Payment

3.1. Placing an Order

When you place an order through our Site, you agree that:

  • You are authorized to use the payment method provided.
  • All billing and shipping details provided are accurate and complete.
  • Your order is subject to availability, and we reserve the right to cancel or refuse any order at our discretion.

Once an order is placed, you will receive an order confirmation email. This does not guarantee acceptance of your order. We reserve the right to limit quantities or cancel orders due to stock shortages, pricing errors, suspected fraud, or violations of these Terms.

3.2. Pricing & Payments

  • All prices are listed in South African Rand (ZAR) and include Value Added Tax (VAT) where applicable.
  • Payments are processed through secure third-party providers. We do not store your payment details.
  • Accepted payment methods will be displayed at checkout.

3.3. Order Cancellation & Changes

  • You may request a cancellation before your order is dispatched by contacting support@drinkfullswing.co.za.
  • If your order has already been shipped, you will need to follow our Returns Policy (see Section 5).
  • Full Swing reserves the right to cancel an order and issue a refund if necessary.

4. Shipping & Delivery

4.1. Shipping Locations

We currently ship within South Africa. If you are outside South Africa and wish to place an order, please contact us at support@drinkfullswing.co.za for assistance.

4.2. Delivery Times

Estimated delivery times will be provided at checkout. While we strive to meet these timelines, delays may occur due to unforeseen circumstances.

4.3. Risk of Loss

Once your order is dispatched, the risk of loss passes to you. If your package is lost in transit, please contact the courier service or reach out to us at support@drinkfullswing.co.za for assistance.

5. Returns & Refunds

We accept returns for unopened and unused Full Swing products within 30 days of purchase. To initiate a return:

  • Contact us at refunds@drinkfullswing.co.za with your order details.
  • Returns must be shipped back in their original condition.
  • The cost of return shipping will be deducted from your refund unless the return is due to a defect or incorrect order.

6. Product Information & Disclaimer

6.1. Product Representation

We strive to provide accurate descriptions and images of our products. However, minor variations in flavour, colour, and packaging may occur.

6.2. Health Disclaimer

  • Full Swing contains caffeine (80mg per 440ml can) and is not recommended for children under 12, pregnant or nursing women, or individuals sensitive to caffeine.
  • Full Swing should be consumed in moderation and does not substitute a healthy diet.
  • Always consult a healthcare professional before consuming if you have any medical conditions.

7. Privacy & Data Protection

We respect your privacy and handle your personal information in compliance with South Africa’s Protection of Personal Information Act (POPIA). By using our Site, you agree to our Privacy Policy, which details how we collect, use, and protect your data.

8. Prohibited Activities

You may not use our Site or Services to:

  • Engage in fraudulent, illegal, or abusive activity.
  • Disrupt the normal operation of our Site.
  • Attempt to gain unauthorized access to our systems.

10. Limitation of Liability

To the extent permitted by South African law:

  • Full Swing is not liable for indirect, incidental, or consequential damages arising from the use of our products or Services.
  • We do not guarantee uninterrupted, error-free access to our Site.
  • Our total liability for any claim will not exceed the amount paid for the affected product.

11. Indemnification

You agree to indemnify and hold FSCO (Pty) Ltd, its affiliates, officers, and employees harmless from any claims, liabilities, or expenses (including legal fees) arising from:

  • Your use of our Site or products.
  • Your violation of these Terms.
  • Any unlawful activities conducted through your account.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of South Africa. Any disputes will be subject to the jurisdiction of South African courts.
